Terms and Conditions

By downloading or using the Encore Frame app, these terms automatically apply to you, so please read them carefully before using the app.

You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, and you should not try to translate the app into other languages or make derivative versions. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, remain the property of SMGator Ventures.

SMGator Ventures is committed to making the app as useful and efficient as possible. For that reason, we reserve the right to make changes to the app at any time and for any reason.

Encore Frame is free to download and use. It also offers an optional Premium upgrade through in-app purchase: a monthly subscription, a yearly subscription, or a one-time Lifetime purchase. Prices are shown in the app before you buy. Subscriptions are billed to your Apple Account and automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the current period ends. You can manage or cancel a subscription at any time in your device Settings under your Apple Account. The one-time Lifetime purchase is a single payment that unlocks Premium permanently and does not renew. Payments, renewals, and refunds are handled by Apple in accordance with Apple's terms; we do not process or store your payment information.

Encore Frame is designed to keep your information on your device. The app reads the photos, videos, and media you choose so that it can display them, and this content stays on your device, and we do not collect it, upload it, or send it to our servers. Any settings and any cloud access tokens are stored locally on your device. It is your responsibility to keep your device and your access to the app secure. We therefore recommend that you do not jailbreak your device, the process of removing software restrictions imposed by the official operating system. Jailbreaking could make your device vulnerable to malware, viruses, and malicious programs, compromise your device's security features, and could mean that Encore Frame does not work properly or at all.

You should be aware that there are certain things SMGator Ventures will not take responsibility for. Some features of the app, such as displaying photos and videos from a connected cloud service, require an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but SMGator Ventures cannot take responsibility for the app not working at full functionality if you do not have Wi-Fi access or you have no remaining data allowance.

If you use the app outside of an area with Wi-Fi, the terms of your agreement with your mobile network provider still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while using the app, or other third-party charges. In using the app, you accept responsibility for any such charges, including roaming data charges if you use the app outside your home territory (region or country) without turning off data roaming. If you are not the bill payer for the device on which you are using the app, we assume you have received permission from the bill payer.

Along the same lines, SMGator Ventures cannot always take responsibility for the way you use the app. For example, you need to make sure your device stays charged. If it runs out of battery and you cannot turn it on to use the Service, SMGator Ventures cannot accept responsibility.

When you connect a third-party cloud service (such as iCloud, Google Drive, Dropbox, or OneDrive), the availability and behavior of that service is outside our control, and your use of it is also governed by that provider's own terms and privacy policy. Although we work to keep Encore Frame updated and functioning correctly, SMGator Ventures accepts no liability for any loss, direct or indirect, that you experience as a result of a third-party service's availability or of relying wholly on the app's functionality.

At some point, we may wish to update the app. Encore Frame is currently available on iOS; the system requirements (and the requirements of any additional platforms we decide to support) may change, and you will need to download updates if you want to keep using the app. SMGator Ventures does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version installed on your device. However, you agree to accept updates to the app when offered to you. We may also wish to stop providing the app, and may terminate its use at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination: (a) the rights and licenses granted to you in these terms will end; and (b) you must stop using the app and, if needed, delete it from your device.

Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. You are therefore advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted.
